1. Agreement to These Terms

Welcome to thefrithteamsaratoga.com (the "Site"). The Site is operated by The Frith Team, a real estate team consisting of Christine Frith and Joseph Frith, licensed real estate professionals associated with Coldwell Banker Prime Properties, a licensed New York real estate brokerage located at 1754 Route 9, Parkwood Plaza, Clifton Park, NY 12065 ("we," "us," "our," or "The Frith Team").

By accessing, browsing, or using this Site, you agree to be bound by these Terms of Use and by our Privacy Policy, which is incorporated here by reference. If you do not agree to these Terms, please do not use the Site.

We may update these Terms at any time. Changes take effect when posted, and the "Last Updated" date above will reflect the most recent revision. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

2. Licensing and Brokerage Disclosure

Christine Frith and Joseph Frith are licensed by the New York State Department of State, Division of Licensing Services, and conduct all licensed real estate activity under the supervision of Coldwell Banker Prime Properties, 1754 Route 9, Parkwood Plaza, Clifton Park, NY 12065, telephone (518) 383-0030.

This Site is maintained by The Frith Team with the authorization of its supervising broker. All real estate services described here are offered through Coldwell Banker Prime Properties. The Frith Team is not itself a licensed brokerage and does not hold listings in its own name.

3. No Brokerage or Agency Relationship

Your use of this Site does not make you our client. Browsing the Site, reading articles, submitting a contact form, requesting information about a property, subscribing to updates, or otherwise communicating with us through the Site does not create an agency, fiduciary, or contractual relationship.

A brokerage relationship is established only through a written agreement signed by you and by an authorized representative of Coldwell Banker Prime Properties. Until such an agreement is executed, we do not owe you the duties a real estate broker owes a client under New York law, and information you share with us should not be assumed to be confidential.

New York State requires real estate licensees to provide consumers with the New York State Disclosure Form for Buyer and Seller, explaining agency relationships and the difference between representation and customer service. That form will be presented to you at the point required by law, generally at first substantive contact regarding a specific property.

4. Eligibility

The Site is intended for users at least 18 years of age who are legally capable of entering binding contracts. By using the Site, you represent that you meet these requirements. The Site is directed to users in the United States and is not intended for use where such use would be contrary to local law.

5. Property Information and Listing Searches

This Site does not host a live MLS or IDX property search. Visitors who wish to search active listings are directed to our brokerage-hosted search at thefrithteam.coldwellbankerprime.com. Those sites are operated by parties other than The Frith Team and are governed by their own terms of use and privacy policies. We do not control their content, availability, accuracy, or data practices.

Any property referenced on this Site — including featured homes, recent sales, neighborhood examples, or properties illustrated in articles — is provided for informational and illustrative purposes only and should not be treated as a current, complete, or verified listing.

Neither The Frith Team, Coldwell Banker Prime Properties, any listing broker, nor any multiple listing service or information provider shall be responsible for typographical errors, misinformation, or misprints, and all such parties shall be held harmless from any damages arising from reliance on this information.

You may not scrape, harvest, mine, republish, resell, or create derivative works from any property data appearing on this Site, or use automated tools to extract it.

6. No Professional Advice

Content on this Site — including blog articles, neighborhood guides, buyer and seller guides, timelines, checklists, and FAQs — is provided for general informational purposes only.

Nothing on this Site constitutes legal, tax, financial, mortgage, insurance, appraisal, engineering, structural, or construction advice. New York real estate transactions involve attorney representation, municipal requirements, and property conditions that vary case by case.

References to New York law, local ordinances, tax rates and exemptions, historic district requirements, short-term rental regulations, school district boundaries, or municipal procedures reflect our general understanding at the time of writing and are subject to change without notice. Joseph Frith's background in construction informs the observational guidance we offer clients during showings. 8. Communications and Consent

9. Acceptable Use

11. Intellectual Property

All original content on this Site — including text, articles, guides, photography, video, graphics, layout, and design — is the property of The Frith Team or its licensors and is protected by United States copyright and trademark law. You may view and print content for personal, non-commercial use only. Any other reproduction, distribution, or republication requires our prior written permission.

Property photographs. Photographs of real property are typically owned by the photographer or listing broker. New York regulation prohibits the use or reproduction of property photographs posted on a broker's website without written permission from the copyright holder. We do not authorize reuse of any property photograph appearing here, and we obtain permission for photographs we publish.

Coldwell Banker®, the Coldwell Banker Logo, and related marks are registered service marks owned by Coldwell Banker Real Estate LLC and are used under license. REALTOR® is a registered collective membership mark owned by the National Association of REALTORS®. MLS® listing data is owned by the applicable multiple listing service. 12. Copyright Complaints (DMCA)

17. Indemnification

You agree to indemnify, defend, and hold harmless The Frith Team, Christine Frith, Joseph Frith, and Coldwell Banker Prime Properties from and against any claims, liabilities, damages, losses, costs, and expenses — including reasonable attorneys' fees — arising out of your use of the Site, your violation of these Terms, or your violation of any law or third-party right.

19. Governing Law and Venue

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Saratoga County or Albany County, New York, and you consent to the personal jurisdiction of those courts.

Nothing in this section limits any right or remedy available to you under New York Real Property Law or the regulations of the New York State Department of State, Division of Licensing Services.

20. General Provisions

Severability. If any provision is found unenforceable, the remaining provisions remain in full force.

No Waiver. Our failure to enforce any provision does not waive our right to enforce it later.

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Frith Team regarding your use of the Site. They do not govern or modify any separate listing agreement, buyer representation agreement, or purchase contract.

Survival. Sections 5, 6, 7, 12, 16, 17, 18, and 20 survive any termination of your access to the Site.
